1. Acceptance of Terms

These Terms of Service ("Terms") are a legal agreement between you ("User" or "you") and Echsee Technologies Pvt Ltd ("Echsee", "we", or "us"), the operator of the Niriksa platform at niriksa.com. By creating an account or using the service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use Niriksa.

2. Description of Service

Niriksa is a screen-recording and QA analysis platform. It lets you capture screen recordings with audio narration, automatically generate structured issue reports using AI, and export results to tools such as Jira, Linear, Notion, and Cursor. Recordings and outputs are saved to your personal Google Drive.

3. Account Registration

• You must sign in using a valid Google account.
• You are responsible for all activity under your account and for keeping your Google credentials secure.
• You may not create multiple accounts to circumvent limits.
• You must provide accurate information and promptly update it if it changes.

4. Subscriptions and Payments

4.1 Plans

Niriksa offers a free tier and paid plans (Beginner, Medium, Pro). Each plan includes a monthly credit allowance and a per-session time cap. Details are shown on the pricing page.

4.2 Credits

Usage is metered in credits. Credits are consumed during recording and screenshot capture. Unused credits do not roll over to the next billing period. Add-on credit packs are available for purchase.

4.3 Billing

• Paid subscriptions are billed in Indian Rupees (INR) via Razorpay for Indian customers, or in US Dollars (USD) via Dodo Payments for international customers, on a monthly or annual cycle.
• Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
• You may cancel a subscription at any time from your account page. Access continues until the end of the current billing period.

4.4 Refunds

Subscription fees are generally non-refundable. We may, at our sole discretion, issue refunds on a case-by-case basis in accordance with applicable Indian consumer protection laws. Add-on credit purchases are non-refundable once credits have been consumed.

5. Acceptable Use

You agree not to:

• Use Niriksa for any unlawful purpose or to record content you do not have the right to capture.
• Reverse engineer, decompile, or disassemble any part of the platform.
• Abuse the AI credit system by automated scripting, bots, or any means designed to circumvent usage limits.
• Attempt to gain unauthorised access to other users' accounts or data.
• Use the service to transmit malware, spam, or any harmful content.

6. Intellectual Property

6.1 Our Property

The Niriksa platform—including its code, UI design, AI prompts, branding, and documentation—is the intellectual property of Echsee Technologies Pvt Ltd and is protected by applicable intellectual-property laws.

6.2 Your Content

You retain full ownership of all content you create using Niriksa—recordings, screenshots, exports, and reports. By using the service you grant us a limited, non-exclusive, royalty-free licence to process your content solely for the purpose of delivering the service (e.g. transcription, AI analysis, cloud saving). This licence terminates when you delete your content or account.

7. Google Drive Integration

• Niriksa accesses Google Drive using the drive.file OAuth scope, which limits access to files and folders created by Niriksa only.
• Your Drive files remain under your full control. You can view, move, or delete them at any time through Google Drive.
• We are not responsible for data loss caused by Google Drive outages, changes to the Google Drive API, or actions you take on those files outside of Niriksa.

8. AI Processing Disclaimer

Niriksa uses third-party AI services (OpenAI) to transcribe audio and generate issue reports. AI-generated content is provided on an "as is" basis and may contain inaccuracies. You are solely responsible for reviewing, verifying, and editing all AI-generated output before relying on it in any professional or production context.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use of the service.
• Our total aggregate liability for any claims arising from your use of Niriksa shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Echsee Technologies Pvt Ltd, its officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the service, or your infringement of any third-party rights.

11. Termination

• We may suspend or terminate your account at any time if you violate these Terms or engage in conduct harmful to other users or the platform.
• You may request account deletion by emailing us at niriksasupport@gmail.com. Upon deletion, your Supabase data will be removed; Google Drive files will remain in your own Drive.
• Sections on Intellectual Property, Limitation of Liability, Indemnification, and Governing Law survive termination.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. Your continued use of Niriksa after changes are posted constitutes acceptance of the updated Terms. If a change is material, we will make reasonable efforts to notify you (e.g. via email or an in-app banner).
